Product: Family Tree
Owner/Company: ("Owner", "we", "our", "us")
"Product" means Family Tree and all related materials, including software, documentation, APIs, data, graphics, text, audio, video, and other components.
"User" means any person or entity that accesses, uses, downloads, installs, or interacts with the Product.
"Content" means all intellectual property included in or generated by the Product.
The Product and all Content included in or associated with the Product are and will remain the exclusive intellectual property of the Owner.
The Product is protected by copyright laws in the United States and other countries, including but not limited to the United States Copyright Act, the Berne Convention, TRIPS, WIPO treaties, and local laws in each jurisdiction where the Product is accessed or distributed.
Title, ownership rights, and intellectual property rights in the Product remain with the Owner and are not transferred to the User under any circumstances.
Subject to these Terms, the Owner grants the User a non-exclusive, non-transferable, revocable license to use the Product for personal or authorized business purposes.

The Owner reserves the right to terminate a User's license and access at any time for any reason, including but not limited to:
Termination is effective immediately upon notice. After termination, all rights granted to the User under these Terms are revoked.
These Terms apply globally and Users in all countries agree to comply with local laws relating to intellectual property, data protection, and usage rights.
Users are responsible for understanding and complying with the laws of their country, including but not limited to:
The Owner may modify these Terms at any time.
Continued use of the Product after notification constitutes acceptance of the changes.
The Product is currently provided free of charge. However, the Owner expressly reserves the right, at its sole and absolute discretion, to introduce fees, subscription charges, premium features, or other pricing structures for access to or use of the Product at any time in the future.
By using the Product, the User acknowledges and agrees that:
Nothing in these Terms shall be construed as an obligation on the part of the Owner to provide the Product free of charge, nor shall prior provision of free services create any expectation, entitlement, or estoppel preventing the Owner from charging for future access.
The Product is provided "AS IS" without warranties of any kind.
To the fullest extent permitted by law, the Owner is not liable for any direct, indirect, incidental, special, or consequential damages arising from use of the Product.
To the extent not preempted by applicable law, these Terms are governed by United States law.
Users agree to submit to the jurisdiction of competent courts for disputes not subject to mandatory jurisdiction elsewhere.
Any family name, family tree, or related record created within the Family Tree Product that contains fewer than two (2) generations or fewer than three (3) individual members is considered incomplete.
Incomplete family trees may be automatically deleted after seven (7) days from the date of creation, without notice.
The Owner has no obligation to retain, restore, or recover deleted family trees that fail to meet the minimum content requirement.
By providing your phone number and opting in to receive text messages from Silver Family Tree, you consent to receive SMS messages from Silver, Inc. relating to your use of the Product, including but not limited to family chat notifications, account-related communications, and updates you have requested.
Message frequency varies based on your account activity and the features you use.
Message and data rates may apply. Standard carrier message and data rates apply to all SMS messages sent and received. Silver, Inc. is not responsible for any charges incurred from your mobile carrier.
You may opt out at any time by replying STOP to any message you receive from us. After replying STOP, you will receive one final confirmation message and no further SMS messages will be sent unless you opt in again.

Supported carriers in the United States and Canada include all major carriers. Carriers are not liable for delayed or undelivered messages.

The family tree visualization design, layout algorithm, and rendering methodology implemented in Silver Family Tree are the proprietary intellectual property of Silver, Inc., founded by Eh P. Xiong and owned by Silver, Inc..
This includes, but is not limited to:
1. No Unauthorized Reproduction. No person, organization, or entity may copy, reproduce, replicate, reverse-engineer, or create derivative works based on the Silver Family Tree layout design, connector algorithm, or visual rendering system without the express prior written consent of Silver, Inc.
2. No Commercial Use. The use of the Silver Family Tree design, in whole or in part, for commercial purposes by any party other than Silver, Inc. is strictly prohibited.
3. No Distribution. The source code, algorithms, and design documents related to the Silver Family Tree layout system may not be distributed, shared, sublicensed, or transferred to any third party without authorization from Silver, Inc.
4. Enforcement. Silver, Inc. reserves the right to pursue all available legal remedies, including but not limited to injunctive relief and monetary damages, against any individual or entity that infringes upon these intellectual property rights.
Patent Pending. The non-crossing connector layout system, color-coded ancestor and descendant connector visualization, automated Hmong cultural kinship terminology engine, and related family tree rendering methods described herein are the subject of a United States Provisional Patent Application filed March 2026 by Eh P. Xiong. Any unauthorized use, reproduction, or implementation of these methods may constitute patent infringement.
Legal Notice: This software and its associated designs are protected under United States copyright law (Title 17, U.S. Code), applicable international copyright treaties, and United States patent law. Unauthorized use, reproduction, or distribution constitutes infringement and may result in civil and criminal penalties.
